HexaKrown LLC ("we," "our," or "us") respects your privacy and is committed to protecting it through our compliance with this policy. This Privacy Policy describes how we collect, use, process, and share your personal information when you use Evernear.ai (the "App") and our related services. By using Evernear.ai, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Information We Collect

We collect several different types of information to provide and improve our service to you:

  • Account Information: When you register, we collect basic information such as your email address, username, password authentication data, and optional profile details.
  • User-Generated Content: Chat messages, uploaded images (e.g., avatars), and custom character configurations.
  • Transaction and Purchase Data: When you make In-App Purchases, we do not collect or store your credit card or direct payment details. Payments are processed by the App Store or Google Play. We only receive purchase receipts and entitlement status.
  • Shipping Information: If you claim "Physical Gifts", we may collect shipping details strictly for fulfilling and delivering the items.
  • Automatically Collected Data: Device type, operating system, unique device identifiers, IP address, and app diagnostic logs.

2. How We Use Your Information

  • To provide, operate, and maintain core functionalities (AI chat and image generation).
  • To process In-App Purchases and maintain virtual currency balances.
  • To fulfill physical gift deliveries.
  • To personalize your experience and remember your companion's memory.
  • To detect and prevent technical issues or abuse.
  • To improve our AI models (Personal chat logs are strictly used to maintain your session context and are not publicly shared).

3. How We Share Your Information

We do not sell your personal information. We only share your data with trusted third parties under the following circumstances:

  • Service Providers: Third-party vendors who assist us (e.g., secure cloud hosting like Supabase, AI Technology Providers/LLMs, and Subscription Management like RevenueCat).
  • Legal Requirements: If required by law or in response to valid requests by public authorities.

4. Data Retention and Account Deletion

We retain your personal information only for as long as is necessary.
Your Right to Delete: You can directly delete your account and all associated data at any time by navigating to Settings -> Delete Account within the Evernear.ai App. Once initiated, your account and associated personal data will be permanently removed.

5. Security of Data

We use commercially acceptable security measures to prevent the loss or misuse of your information. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee its absolute security.

6. Children's Privacy

Evernear.ai is not intended for use by anyone under the age of 18. We do not knowingly collect personally identifiable information from children.

7. Important Safety Note

Evernear.ai provides AI-generated emotional companionship for entertainment purposes only. The AI is not a licensed therapist, doctor, or emergency service. It should not be used for crisis situations. If you are in immediate danger, please contact your local emergency services.

Welcome to Evernear.ai ("we," "our," or "us"). By downloading, accessing, or using the Evernear.ai application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Eligibility

You must be at least 18 years of age to use this App. By using Evernear.ai, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract. We reserve the absolute right to terminate your account without notice if we believe you are under 18.

2. Nature of Service & Important Medical Disclaimer

Evernear.ai provides an artificial intelligence companion designed strictly for entertainment and emotional companionship purposes only.

  • Not Medical Advice: The AI is NOT a licensed therapist, psychologist, doctor, or healthcare professional.
  • No Crisis Support: The App should never be used for medical diagnoses, psychological therapy, or crisis situations. If you are experiencing a mental health emergency, please contact your local emergency services immediately. We assume no liability for any reliance on the AI's responses.

3. In-App Purchases and Virtual Currency (NEAR Coins)

The App may offer the ability to purchase a limited, revocable, non-exclusive, non-transferable license to use virtual currency ("NEAR Coins") or other digital features.

  • No Real-World Value: NEAR Coins and digital items have no cash value and cannot be exchanged for real money, real goods, or real services from us or anyone else.
  • No Refunds: All sales of digital content and virtual currency are FINAL AND NON-REFUNDABLE, to the maximum extent permitted by applicable law and the policies of the Apple App Store and Google Play Store.
  • Our Absolute Rights: We reserve the right to manage, regulate, control, modify, or eliminate NEAR Coins and digital items at any time, in our sole discretion, without any liability to you.

4. Loyalty Milestones & Promotional Rewards (Physical Gifts)

As part of the App's entertainment experience, users may reach certain relationship milestones ("Lover Level") with their AI companion. From time to time, at our sole and absolute discretion, we may offer promotional loyalty rewards, which may include physical items, to eligible users.

  • Not a Purchase: These rewards are strictly free promotional bonuses. You are not purchasing physical goods through the App or with NEAR Coins.
  • No Guarantee: We do not guarantee the availability, delivery, or quality of any promotional physical rewards. We reserve the right to modify, substitute, or cancel the physical gift program, or deny delivery to any specific user or region, at any time without prior notice or compensation.

5. User-Generated Content (UGC) & AI Interactions

Evernear.ai allows you to interact with AI, generate images, and post content to the Community section.

  • Zero Tolerance Policy: You may not use the App to generate, upload, or share content that is illegal, defamatory, harassing, sexually explicit (in public community areas), involves child sexual abuse material (CSAM), or violates any third-party rights.
  • Our Right to Monitor and Remove: To comply with Apple and Google Play policies, we reserve the right (but have no obligation) to review, monitor, and remove any User Content at our sole discretion, at any time, for any reason, without notice.
  • AI Outputs: AI-generated text and images are unpredictable. We are not responsible for any offensive, inaccurate, or inappropriate content generated by the AI. You use the AI features at your own risk.

6. Account Termination

We are granting you a privilege to use the App, not a right. We reserve the right to suspend, disable, or terminate your account and your access to the App at any time, for any reason or no reason, in our sole discretion, without prior notice or liability. Upon termination, you will forfeit any accumulated NEAR Coins, digital items, and access to chat histories, with no right to a refund.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERNEAR.AI AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF THE AI COMPANION; OR (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
